American Fork Canyon USFS and Private Property Sites
I toured the sites in American Fork Canyon (AFC) on September 12 and 13, 2000, with
personnel from the USFS, UDERR, BuRec, and the local health department. My findings are that
there are two sites that meet the criteria for time critical Removal actions that should be pursued
immediately for clean up next spring.
Your letter indicates that the National Contingency Plan requires that ARARs be met to the extent
practicable fbrCERCLA removal actions (40 CFR 300.4 15(i)). However, this do>::s not mean
that ARARs only need to be met if it is convenient to do-so.
As I told Pete yesterday, I am working on outyear budget requests for 2003. For this purpose, FS is following a scenario that includes EPA as a cooperator/partner but assumes that funding will not be forthcoming from EPA.

This article ran in the Deseret News last week. It is fairly accurate but as
always words were put in my mouth:
Carol Russell with EPA sent me this lead to potential grands from USF&W for
abandoned mine lands reclamation.
Pacific Mine is listed on EPA’s CERLIS list due to past and potential future releases of
heavy metals from the site into the adjacent environment and public lands and waters.
Trout Unlimited and Snowbird, as well as other partners, are considering an action to
reduce the potential for future releases from this site by consolidating and covering the
mine and mill wastes on site. But we are concerned about our future liability under
CERCLA for these mine wastes if we engage in the cleanup effort of private lands.
I spoke at some length with Carol Russell, EPA’s Region 8 Mining Team Leader,
today about our concerns with future liability at not only the AFC mine
reclamation project but the many other sites that may receive attention under
the Settled, Mined, and Left Behind program. I asked her specifically about
“Administrative Orders on Consent”. As I suspected such an order is issued
under CERCLA authority.
I am mailing the letter contained in the attachment today. The letter has
gone through TU’s staff review and they concur that the requested information
is critically needed so we can properly determine our future course of action
in AFC. We really need to better understand our potential Federal liabilities
if indeed we engage in a removal action at Pacific Mine and elsewhere in the
western United States.

mine dump yesterday. I GPS’d the sample sites where we tested the soils
for heavy metals. The Mill Site had very high lead concentrations. The

in connection with property including the Pacific Mine Waste Rock Pile, the Pacific Mill Site,
the Blue Rock Mine Waste Rock Pile, and the Scotchman No. 2 Mine Waste Rock Pile, all
located on the North Fork of the American Fork River, in American Fork Canyon, Utah County,
Utah. This Order reflects the current unique circumstances and is not intended to serve as a
model for any other administrative order or agreement.
2. This Order is issued under the authority vested in the President of the United States by
Sections 106(a), 107(a) and 122(a) of the Comprehensive Environmental Response,
Compensation, and Liability Act of 1980, 42 U.S.C. §§ 9606(a), 9607(a), and 9622(a), as
amended, and the inherent authority of the Attorney General of the United .States to compromise
and settle claims of the United States.
This Removal Action will address the need to mitigate the threats to the environment, tourists/recreational
visitors, and animals/wildlife on a portion of the Site. The threat is posed by high concentrations of metals
(especially lead, zinc, arsenic, and mercury) in the waste rock, tailings pile, and mine drainage from the
former Pacific Mine.
This endangerment assessment describes human health and environmental risks associated with
metals contamination at two mine sites in American Fork Canyon, Uinta National Forest in Utah
County, Utah. Health and environmental risks at the site include impacts to human health through
recreational use of the mine sites and resulting inhalation, dermal and ingestion exposure to
metals-contaminated tailings and soils. In addition, a potential for human exposure to metals
exists through the consumption of locally caught contaminated fish. Environmental impacts
include the potential effects of contaminated soil and mine runoff on terrestrial and aquatic
ecological receptors.

This Health and Safety Action Plan provides guidelines for implementing Stage 1 of Trout
Unlimited’s (TU) restoration of the Pacific Mine project in American Fork Canyon, Utah. The
plan will be reviewed thoroughly with all personnel working on the project including TU’s
employees, contactors, subcontractors, equipment owner/operators, and other personnel engaged
in this work’. The plan intends compliance with the statutory requirements of the State of Utah
Labor Commission, UOSH, Federal OSHA, Department of Transportation, EPA, and Local
Health Department standards and regulations. The Plan is designed and used to achieve a safe and
healthy work environment, to prevent damage to equipment, and property and to protect
employees and subcontractors.

criteria for time critical Removal actions that will need further Removal investigation which
should be scheduled next spring. For planning purposes, Removal activity and investigations can
be reliably conducted from about June 1 to October 15, depending on snow pack.
I have reviewed the submitted project plan for the performance of work at the Pacific
Mine Site, which includes the Pacific Mine Waste Rock Pile, the Pacific Mill Site, the Blue Rock
Mine Waste Rock Pile, and the Scotchman No. 2 Mine Waste Rock Pile, all located on the North
Fork of the American Fork River in American Fork Canyon, Utah County, Utah . The work is
set forth as Stage 2 in the attached work plan and will involve consolidation of mine waste
materials and control of erosion at the various rock piles and waste areas within the Pacific Mine
Site to eliminate the threat to public health and the environment caused by release of arsenic,
cadmium, copper, lead and zinc from those areas.
